Those people weren't buying games anyway. Those are the same people who are running homebrewed and modded Switches and are pirating games regardless. Nintendo can put a stop to it by scaling games to their hardware better and put out beefier hardware.

I really think that's a naive mindset, most of these people aren't emulating because they want the better experience. Well, there are also PC game pirates and DRM-disabling patches by them, games leak early for PC pirates, etc. etc.
Yet, the variety of storefronts and accessible prices globally for technologically competent ports of PC games are plentiful, so while those pirates do exist, and they brag, and they brag about how much they don't pay for shit, that doesn't change the conversation, the ethics, or the economics: accessibility kills the interest and validity in piracy.

People buy a lot of Steam/Ubi/Epic/EA PC games now versus pirating PC games because they're easy to buy and keep throughout the generations and keep up to date with graphics and hardware for competitive prices. It's the same thing as when streaming services for music and TV began--people stopped pirating TV and music as much. Most of the people who do pirate probably wouldn't even feel the need to download obscurely hidden copies of ROMs off the internet to old-ass Nintendo games if they could access their games legally and cheaply in good quality. Similarly, people wouldn't feel the need to grasp for 4K60/120 on PC and Android hardware if Nintendo games didn't perform so poorly on native hardware.

I feel if Nintendo wanted good will AND to protect their IP (I'm not a lawyer, so I'm not gonna pretend to armchair law, but this is my uneducated opinion), they should release a subscription service to their entire catalog that is $X/mo to compete with Sony and MS. They should offer hardware upscaling to Switch games both digitally and physically. They should release the unreleased Wii and Wii U games for Switch/2. And they should hire (not bribe or jail) emulation technical leaders to contribute to their hardware innovation and security. But instead it feels like they're more interested in policing their IPs, shutting down association of Smash Bros. with fighting tournaments, DMCA'ing ordinary people on YouTube, and keeping most of their games pretty cishet (the needle on this is moving, but at a glacial pace). I feel incredibly punished as a Nintendo fan. I have had thousands of dollars of their games stranded across multiple plastic junk devices now with no consistent way to play it all until emulation came into my life, and Nintendo just wants to force me to play it all at 520p 25fps or to fuck off.

To me, some people's relentless excusing of Nintendo's clearly bad faith behavior here is just as bad as Disney apologists that think Disney bullying around federal copyright laws to their benefit every few years to keep their characters out of the public domain to "protect their IP" is admirable because people adore Disney IPs.
